Conditions of Use

In this page the term "Website" refers to the Montreal Lawn Inc. website and all its applications (Extranet, mailing systems and others). On the Website, the term www.montreal-lawn.ca means the same as Montreal Lawn Inc.

By registering online, placing orders and through your continued use of this Website, you accept all terms and conditions of this Agreement and create a legally binding contract with Montreal Lawn Inc. for lawn maintenance and treatment. Limitation of Liability and Indemnification

Montreal Lawn Inc. reserves the right to use its sole discretion in refusing in carrying out any work it deems improper or known to be illegal. We are not liable for any damages resulting from unwitting violation of property rights. The client guarantees the legal title of all property submitted to Montreal Lawn Inc. for lawn maintenance and treatment.

In the event that a charge, claim or demand, or arbitration, action or proceeding (collectively, a "Claim") is made or commenced against Montreal Lawn Inc. based upon, relating to or arising from the alleged wrongful acts of the customer’s, or alleging that the lawn maintenance or treatment performed or product sold by Montreal Lawn Inc. ordered by the customer: (a.) infringes any property rights of any person, the customer agrees to indemnifying and holding Montreal Lawn Inc. harmless from and against any loss, damages, cost and expense arising from or related to the Claim including without limitation; (1.) defending Montreal Lawn Inc. against any such Claim (2.) paying any judgment or award against the customer; and (3.) reimbursing Montreal Lawn Inc. for any legal fees and expenses it reasonably incurs in responding.

For legal purposes, the venue for any dispute shall be Montreal, Quebec Canada.

Liability and Warranty

Montreal Lawn Inc.'s liability for any defective service or product shall be limited to the stated selling price to the customer and shall in no event include special, consequential, incidental, indirect or similar damages, including but without limitation, loss of profits.

Montreal Lawn Inc. warrants that every service or product provided by it meets industry standard for such service or product and is free of any material defect in workmanship. IT IS EXPRESSLY AGREED THAT THIS WARRANTY IS IN LIEU OF ALL WARRANTIES OF FITNESS FOR PARTICULAR USE AND MERCHANTABILITY. Montreal Lawn Inc. makes no other warranty and no actions or words of Montreal Lawn Inc. or its officers, employees or agents shall constitute a warranty. If any order does not match the generally accepted trade standards, we will redo the work or issue the customer a refund at our discretion.

Claims

The client must submit a claim in writing no later than 5 calendar days after delivery for any defects or damages. If no such claim is made, Montreal Lawn Inc. and the client are in agreement that the job has been accepted. By accepting the job, the client recognizes that Montreal Lawn Inc.’s performance has fully satisfied all terms, conditions and specifications.

Copyright Protection

The information on this Website is protected by copyright laws and intellectual property rights. You will need a written authorization from Montreal Lawn Inc. to use this information. Partial or total reproduction or diffusion is strictly prohibited (information, text, images, graphics or others) without Montreal Lawn Inc.'s authorization.
